Thesing GmbH, Torstraße 72, 10119 Berlin, Germany · Email: hi@thesing.de · Phone: +49 171 2643388

2. Hosting and shop system (Shopify)

Our online shop runs on the Shopify platform (Shopify International Limited, Victoria Buildings, 2nd Floor, 1–2 Haddington Road, Dublin 4, Ireland). Shopify generally processes the data arising from visiting and using the shop as our processor (Art. 28 GDPR). For certain of its own services – such as Shop Pay, the Shop app and fraud prevention – Shopify processes data as an independent controller; Shopify's privacy policy applies: https://www.shopify.com/legal/privacy

When you visit the shop, technically necessary data is collected (e.g. IP address, date and time, pages visited, browser and device information, referrer URL). The legal basis is our legitimate interest in a secure and functioning shop (Art. 6(1)(f) GDPR). Server log files are only stored for as long as necessary for the secure operation of the shop and to detect and prevent misuse.

Shopify may also process data in Canada and the USA. For Canada, an adequacy decision of the European Commission applies; transfers to the USA are based on the European Commission's standard contractual clauses (Art. 46(2)(c) GDPR).

3. Orders and customer account

When you place an order, we process the data required to perform the contract: name, delivery and billing address, email address, phone number (optional), order details and payment status. The legal basis is the performance of a contract (Art. 6(1)(b) GDPR).

If you create a customer account, we store your data for future orders until you delete your account (Art. 6(1)(b) GDPR).

We retain documents relevant under tax and commercial law, such as order and invoice data, in accordance with statutory retention periods, which are six, eight or ten years depending on the type of document (§ 147 German Fiscal Code, § 257 German Commercial Code; Art. 6(1)(c) GDPR). After that, we delete the data unless other legal reasons require its storage. For our accounting, we use sevdesk by sevDesk GmbH, Offenburg, Germany, as our processor.

4. Payment processing

To process your payment, we pass the necessary data to the payment service you have chosen (Art. 6(1)(b) GDPR):

  • Shopify Payments (credit cards, Shop Pay, Apple Pay, Google Pay and local payment methods such as Bancontact, EPS, iDEAL | Wero, Bizum and MobilePay)
  • PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg
  • Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden

The payment services partly process your data under their own responsibility; their privacy policies apply. Klarna may carry out a credit check for the selected payment method.

5. Shipping and fulfilment

For delivery, we pass your name, delivery address and order information to our fulfilment service provider acut fulfillment GmbH, Alboinplatz 19, 12105 Berlin, Germany (processor), and to the carrier commissioned in each case, e.g. Deutsche Post / DHL. The legal basis is Art. 6(1)(b) GDPR. Your email address and phone number may be passed to the carrier so that it can announce and coordinate the delivery (Art. 6(1)(b) GDPR).

6. Returns and exchanges

For practical returns and exchanges, we use the return portal provided by AfterShip (processor). We process your order number, email address, name, address, phone number, the items concerned and your return or exchange request in order to process the return, create a return label and handle the refund or exchange (Art. 6(1)(b) GDPR).

The return portal is used for the practical processing of returns and exchanges and is separate from the exercise of your statutory right of withdrawal via our withdrawal form.

Transfers outside the EEA are based on the European Commission's standard contractual clauses (Art. 46(2)(c) GDPR).

7. Withdrawal form

If you exercise your right of withdrawal via our online form at thesing.de/pages/withdraw, we process your email address, your order number, your name (optional), the items concerned, any reason or message you choose to provide, and the date and time of your withdrawal in order to process your withdrawal, acknowledge its receipt and document the exercise of your statutory right. The legal basis is compliance with our legal obligations (Art. 6(1)(c) GDPR) and, where applicable, the performance of the contract (Art. 6(1)(b) GDPR).

We use the app Revoq – EU Withdrawal Button, provided by Jonas Busch, Hofstraße 2–4, 51061 Cologne, Germany, as our processor (Art. 28 GDPR) for the form and the acknowledgement email. The data is stored on servers within the European Union. The data submitted through this form is not used for marketing purposes, and submitting the form does not subscribe you to our newsletter.

We retain the data for as long as necessary to process the withdrawal and, where applicable, for the duration of statutory retention periods.

8. Contact

If you contact us by email or via the contact form, we process your details to handle your request (Art. 6(1)(b) or (f) GDPR). We delete the data once your request has been fully processed and no statutory retention obligations apply.

9. Newsletter (Klaviyo)

If you subscribe to our newsletter, we use your email address to send you information about new products, drops and offers. The legal basis is your consent (Art. 6(1)(a) GDPR). After signing up, you will receive an email asking you to confirm your subscription (double opt-in). Only then will you be added to the mailing list. We store the time of sign-up and confirmation as proof.

We use Klaviyo, Inc., 125 Summer Street, Boston, MA 02110, USA (processor) to send the newsletter. Klaviyo analyses whether newsletters are opened and links are clicked in order to improve our mailings. On our website, Klaviyo only records interactions if you have consented to marketing cookies. Transfers to the USA are based on the adequacy decision for the EU-US Data Privacy Framework (Klaviyo, Inc. is certified).

You can unsubscribe at any time via the link in every email. After you unsubscribe, we delete your data unless we need it to prove your consent.

10. Cookies and consent management

We use cookies and similar technologies. We set technically necessary cookies (e.g. cart, login, storing your cookie choice) on the basis of § 25(2) German Telecommunications Digital Services Data Protection Act (TDDDG) and Art. 6(1)(f) GDPR. All other cookies – for personalisation, analytics and marketing – are only set with your consent (§ 25(1) TDDDG, Art. 6(1)(a) GDPR).

We manage your consent with Shopify's consent tool. You can change or withdraw your choice at any time via “Cookie Settings” in the footer. We treat a Global Privacy Control (GPC) signal from your browser as an objection to analytics and marketing cookies. Information on Shopify cookies: https://www.shopify.com/legal/cookies

11. Analytics

With your consent, we use Shopify Analytics to statistically evaluate the use of our shop (Art. 6(1)(a) GDPR).

12. Marketing (Meta Pixel)

With your consent (Art. 6(1)(a) GDPR), we use the Meta Pixel of Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. It allows us to measure the effectiveness of our ads on Facebook and Instagram and to show ads to people who have shown interest in our products. In addition – also only with your consent – we transmit events such as page views, cart and purchases directly from our server to Meta (Conversions API); hashed contact data such as your email address may be transmitted so that Meta can match the events. We are jointly responsible with Meta for collecting the data and transmitting it to Meta (Art. 26 GDPR); the agreement is available at https://www.facebook.com/legal/controller_addendum. Meta may transfer data to the USA on the basis of the adequacy decision for the EU-US Data Privacy Framework (Meta Platforms, Inc. is certified). More information: https://www.facebook.com/privacy/policy

13. Marketing (Pinterest Tag)

With your consent (Art. 6(1)(a) GDPR), we use the Pinterest Tag of Pinterest Europe Ltd., Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland. It allows us to measure the effectiveness of our ads on Pinterest and to show ads to people who have shown interest in our products. Data is transmitted via the browser and server-side; hashed contact data may be transferred. Pinterest may transfer data to the USA on the basis of the adequacy decision for the EU-US Data Privacy Framework (Pinterest Inc. is certified). More information: https://policy.pinterest.com/en/privacy-policy

14. Other services in the shop

  • Pre-orders (STOQ): For pre-orders, the STOQ app processes order and contact data (Art. 6(1)(b) GDPR). The STOQ pixel is only used for the pre-order function and therefore loads regardless of your cookie choice (§ 25(2) no. 2 TDDDG).
  • Spam protection (hCaptcha): To protect our contact forms and customer account pages from spam and misuse, Shopify uses hCaptcha, a service of Intuition Machines, Inc., USA. hCaptcha analyses technical data such as your IP address, browser information and interactions with the page to distinguish humans from automated bots (Art. 6(1)(f) GDPR; § 25(2) no. 2 TDDDG). Transfers to the USA are based on the adequacy decision for the EU-US Data Privacy Framework (Intuition Machines, Inc. is certified).
  • Shop extensions: Apps for design and sales features (Hoppy Trust Badges, Pop Convert, TimexBar, Essential Upsell, Hey! Low Stock, PageFly, Shogun) display notices, countdowns, upsell offers and page layouts. When they load, technical data such as your IP address may be transmitted to the providers (Art. 6(1)(f) GDPR).
  • B2B orders: For retailers, we process company and contact data via NuORDER (Art. 6(1)(b) GDPR). This only concerns business customers.
  • Internal administration with AI tools: For internal tasks such as order and return analysis and customer service preparation, we use AI tools from Anthropic (Claude), which can access data in our shop system via an integration. In this context, Anthropic may process order and customer data on our behalf as our processor (Art. 28 GDPR). The legal basis is our legitimate interest in efficient business processes (Art. 6(1)(f) GDPR). Your data is not used to train AI models. Transfers to the USA are based on the European Commission's standard contractual clauses (Art. 46(2)(c) GDPR).

15. Social media

Our website links to our social media profiles (e.g. Instagram). These are simple links; data is only transmitted to the respective provider when you click on them.

16. Recipients and international transfers

Recipients of your data are the service providers named in this policy and, where legally required, public authorities (e.g. tax offices). We do not sell personal data. Transfers to countries outside the EEA only take place on the basis of an adequacy decision (e.g. Canada, or the USA for companies certified under the EU-US Data Privacy Framework) or appropriate safeguards such as standard contractual clauses (Art. 44 et seq. GDPR).

17. Retention

We only store personal data for as long as necessary for the respective purpose or as required by statutory retention periods. Details can be found in the individual sections.

18. Your rights

You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20), as well as the right to withdraw any consent at any time with effect for the future (Art. 7(3) GDPR). Please contact hi@thesing.de.

Right to object: Where we process data on the basis of legitimate interests (Art. 6(1)(f) GDPR), you may object at any time on grounds relating to your particular situation (Art. 21(1) GDPR). You may object to processing for direct marketing purposes at any time without giving reasons (Art. 21(2) GDPR).

19. Right to lodge a complaint

You have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is the Berlin Commissioner for Data Protection and Freedom of Information, Alt-Moabit 59–61, 10555 Berlin, https://www.datenschutz-berlin.de

20. Obligation to provide data, automated decisions

Providing the data required for an order is necessary to conclude the contract; without it we cannot process your order. No automated decision-making with legal effect (Art. 22 GDPR) takes place.

21. Children

Our offer is not directed at children under 16. We do not knowingly process children's data.
